Terms & Conditions for gTLDs domain name

gTLD DOMAIN NAMES REGISTRATION AGREEMENT

1. General principles for registering gTLD domains:

1. The Registered Name Holder must comply with P.A Viet Nam Terms & Conditions
2. The Registered Name Holder must comply with all ICANN regulations regarding the registration and use of gTLD domain names: Rights and responsibilities of gTLD domain name registrants
3. Registered domain names must comply with the provisions of Circular No. 24/2015/TT-BTTTT dated August 18, 2015 of the Ministry of Information and Communications guiding the management and use of Internet resources and Circular No. 21 /2021/TT-BTTTT dated December 8, 2021 amending and supplementing a number of articles of Circular No. 24/2015/TT-BTTTT.
4. The Registered Name Holder must ensure that there are no phrases that infringe upon the national interests or are inconsistent with social ethics, fine customs and traditions of the nation; must show seriousness to avoid misunderstanding or misrepresentation due to polyphony, polysemy or when not using accents in Vietnamese.
5. The Registered Name Holder in Vietnam need to fulfill the obligation of Responsibility of gTLD domain name registrants to avoid administrative sanctions under Article 44 of Decree No 15/2020/ND-CP dated February 3, 2020 of the Government and Decree No. 14/2022/ND-CP February 3, 2020 amending and supplementing a number of articles of Decree No. 15/2020/ND-CP.

2. Rights and Responsibilities of The Registered Name Holder:

2.1 Rights:

2. Be guided by P.A Viet Nam on policies and technical support related to gTLD domain names.

2.2 Responsibilities:

2. The Registered Name Holder must submit the Domain name registration declaration contact detail according to the form The Registrar (P.A Viet Nam) provides with complete and accurate domain name information as prescribed below within seven (7) days:
   - The full name, postal address, e-mail address, voice telephone number, and fax number if available of the Registered Name Holder
   - The name of authorized person for contact purposes in the case of an Registered Name Holder that is an organization, association, or corporation
   - The names of the primary nameserver and secondary nameserver(s) for the Registered Name
   - The name, postal address, e-mail address, voice telephone number, and (where available) fax number of the technical contact for the Registered Name
   - The name, postal address, e-mail address, voice telephone number, and (where available) fax number of the administrative contact for the Registered Name
   - The names of the primary nameserver and secondary nameserver(s) for the Registered Name
   
3. When The Registered Name Holder changes name or contact information such as address, phone, fax, email, Citizen Identification Number or Tax Code. The Registered Name Holder must immediately notify the Registrar to update the domain name's system and database, ensuring accurate information. And is responsible for updating these changes at the address: thongbaotenmien.vn (According to Article 23 of the Law on Information Technology No. 67/2006/QH 11 dated June 29, 2009) within seven (7) days
4. If The Registered Name Holder provides the right to use the domain name to a third party, The Registered Name Holder is still responsible for providing their contact information and is responsible for handling issues that arise related to this domain name. Unless The Registered Name Holder discloses the current contact information provided by the licensee and the identity of the licensee within seven (7) days to a party providing the Registered Name Holder reasonable evidence of actionable harm.
5. The Registered Name Holder must actively monitor information on the operation status and validity period of the registered domain names, and pay the maintenance fee before the domain name expires. Renewal fees are announced by P.A Viet Nam at: https://www.pavietnam.vn/en/ten-mien-bang-gia.html
6. The Registered Name Holder must comply with the procedures and costs related to gTLD domain names published at: https://www.pavietnam.vn/en/gtld-domain-faqs.html
7. Accept the information confidentiality agreement that P.A Viet Nam announced at: https://www.pavietnam.vn/en/user-information-security-policy.html
If The Registered Name Holder provides the right to use the domain name to a third party, they must also ensure that the third party agrees to comply with these terms.
8. The Registered Name Holder must be responsible for managing and using the registered domain name in accordance with the Vietnam law on Internet resources. And the registration and use of this domain name, directly or indirectly, does not violate the legal rights of any third party.
9. For the adjudication of disputes concerning or arising from use of the domain name, the Registrant shall submit, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (1) of the Registrant’s domicile, and (2) where P.A Viet Nam is located, presently Ho Chi Minh City, Vietnam.
10. When a dispute arises or arises related to a domain name, The Registered Name Holder must respond and provide information to handle the dispute. The Registered Name Holder shall agree that its registration of the Registered Name shall be subject to suspension, cancellation, or transfer (1) to correct mistakes by Registrar or the Registry Operator in registering the name or (2) for the resolution of disputes concerning the Registered Name.
11. The Registered Name Holder shall indemnify and hold harmless the Registry Operator and its directors, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees and expenses) arising out of or related to The Registered Name Holder's domain name registration. P.A Viet Nam cannot and will not be liable for any loss or damage arising from The Registered Name Holder's failure to comply with this provision.
12. The Registered Name Holder is obliged to accept that P.A Viet Nam and the registry have the right to  refuse the transfer of domain names in the following cases:
    - Do not transfer domain registrars within sixty (60) days from the date the domain name is newly registered; or have just changed registrar; or have just changed the whois information of the domain name.
    - Domain names are in dispute or in violation.
    - The domain name is in the process of being inbound transferred to another The Registered Name Holder.
    - Domain name payment has not been completed.

3. Rights and Responsibilities of registrar - P.A Viet Nam:

3.1 Rights:

1. Has the right to suspend a domain name if The Registered Name Holder does not provide or provides incorrect information about the owner's name, address, email, phone number, Citizen Identification Number or Tax Code within seven (7) days from the date of request.
2. Has the right to suspend your domain name if you do not renew it when the domain name expires.
3. Has the right to suspend your domain name if you violate the domain name usage regulations in this agreement.

3.2 Responsibilities:

1. Support users to register and renew domain names.
2. Implement notification of domain name renewal when the domain name is about to expire according to ICANN regulations. Specifically, The Registered Name Holder will be notified by email to renew:
   - Before expiration: Send notice at least 02 times, one notice sent 01 month before the expiration date and the other notice sent 01 week before the expiration date.
   - After expiration: Send notification once within 05 days from the expiration date.
3. Provides tools for users to manage domain names.
4. Make sure the domain name's DNS system operates stably.
5. Support users when domain names encounter problems or disputes.

7. Instruct The Registered Name Holder to notify the using of domain names according to the provisions of Article 23 of the Law on Information Technology No. 67/2006/QH 11 dated June 29, 2009.
